This agreement
These terms of use form the agreement between you and HKjobs Limited (“HKjobs”, “we”, “us”), a company incorporated in Hong Kong with its office at 21/F, Harbourpoint Tower, 68 Hoi Yuen Path, Quarry Bay, in respect of hkjobs.demo and everything on it (the “Service”).
By using the Service you accept these terms. If you are accepting on behalf of an organisation, you confirm you are authorised to bind it, and “you” means that organisation.
Our privacy policy forms part of this agreement. Where an employer has signed a separate order form or insertion order with us, that document prevails over these terms to the extent of any conflict.
Who may use HKjobs
You may use the Service if:
- you are at least 18 years old;
- you can form a binding contract and are not barred from doing so under any applicable law;
- for job seekers, you are genuinely seeking employment for yourself and the information you give about your experience is true;
- for employers, you are advertising a genuine vacancy that you are authorised to fill.
Applying through HKjobs does not confer any right to work in Hong Kong. Immigration status is determined by the Immigration Department alone, and nothing on the Service is an assurance that a visa will be granted.
Your account
You are responsible for the credentials on your account and for everything done through it. Tell us immediately at trust@hkjobs.demo if you believe it has been accessed by someone else.
One person, one account. Employer accounts are issued to named individuals within an organisation; sharing a single login across a hiring team defeats the audit trail on the pipeline and is not permitted.
Terms for job seekers
HKjobs is free for job seekers, without exception. We do not charge you to search, to apply, to be shortlisted, or to appear higher in an employer’s list. There is no paid candidate tier and we undertake not to introduce one under this agreement.
Part XII of the Employment Ordinance (Cap. 57) caps what a licensed employment agency may receive from a job seeker at the prescribed commission, payable only after a successful placement. Our charge is nil. If anyone claiming to act for HKjobs asks you for money, a deposit, a training payment or your banking details, it is not us — report it.
When you apply through the Service you agree that:
- your application, CV and screening answers are transmitted to that employer, who becomes a separate data user in respect of them;
- the content you submit is accurate and yours to submit, and does not include confidential information belonging to a current or former employer;
- HKjobs is not a party to any employment relationship that results, and makes no promise that you will receive a reply, an interview or an offer.
Terms for employers
By publishing a listing you represent and warrant that:
- the vacancy is genuine, currently open, and for employment or engagement on the terms described;
- the salary band is published in good faith and reflects what you are genuinely prepared to pay for the role;
- the listing complies with the Employment Ordinance (Cap. 57), the Minimum Wage Ordinance (Cap. 608), the Mandatory Provident Fund Schemes Ordinance (Cap. 485) and every other applicable Hong Kong law;
- if you place candidates with other employers, you hold a valid employment agency licence under Part XII of the Employment Ordinance and have given us the licence number;
- you will handle applicant data in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) and use it only to assess candidates for the vacancy advertised.
Response rates and median reply times shown on your profile are calculated by us from platform activity. They are a factual record of conduct on the Service and cannot be edited, hidden or suppressed by payment.
Listing content standards
Every listing is reviewed before publication. We reject, and may remove after publication, any listing that:
- omits a salary band without an approved exemption reason;
- imposes or implies a criterion that would contravene the Sex Discrimination Ordinance (Cap. 480), the Disability Discrimination Ordinance (Cap. 487), the Family Status Discrimination Ordinance (Cap. 527) or the Race Discrimination Ordinance (Cap. 602) — including age limits, “young and energetic”, requirements as to marital status or pregnancy, and language demands that are a proxy for nationality rather than a genuine requirement of the job;
- requires the candidate to pay anything — training bonds, uniform or equipment deposits, agency fees, or the purchase of stock;
- describes a commission-only, multi-level marketing or investment recruitment scheme presented as employment;
- cannot be tied to a verifiable business registration, or gives contact details inconsistent with it;
- is duplicated across multiple listings to occupy more of the results page, or is materially misleading about the employer’s identity.
Rejections are explained, and you may resubmit. Repeated breaches end the account and forfeit any unused balance.
Fees, billing and refunds
Fees apply to employers only and are quoted and charged in Hong Kong dollars. Current prices are published on our pricing page and form part of this agreement.
- A standard listing runs 30 days from approval. Subscriptions renew automatically until cancelled, and we email the billing contact before each renewal.
- A listing that receives no applications may be cancelled within 14 days for a full refund. Once applications have arrived, we credit the unused portion to your account instead.
- Annual plans may be cancelled within 14 days of the first charge where no listing has been published.
- A listing we reject is never charged for, and any pre-authorisation is released the same day.
- If a payment fails, listings remain live for a seven-day grace period, after which they are unpublished rather than deleted.
Hong Kong does not levy VAT, GST or a general sales tax; invoices show the net amount. Any tax arising in your own jurisdiction is your responsibility.
Intellectual property
The Service, its design, code, the HKjobs name and the salary benchmark methodology belong to us or our licensors. Nothing here transfers any of it to you.
You keep ownership of the content you submit. By submitting it you grant HKjobs a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display it for the purpose of operating the Service — for a job seeker, that means showing your application to the employer you applied to; for an employer, that means publishing your listing. The licence ends when the content is deleted, save for copies retained under the retention schedule in our privacy policy.
Aggregate, de-identified statistics derived from listings — the salary guide among them — belong to HKjobs and may be published.
Acceptable use
You must not:
- scrape, crawl, harvest or bulk-download listings, profiles or salary data, or use automated means to access the Service other than a search engine crawler obeying our robots directives;
- copy our salary data into a competing product, or present it as your own research;
- contact candidates for any purpose other than the vacancy they applied to, or add them to a marketing list;
- impersonate a person or organisation, or advertise on behalf of an employer without authority;
- probe, scan or test the vulnerability of the Service, or interfere with its operation;
- upload malicious code, or anything unlawful, defamatory or obscene.
Security researchers acting in good faith should write to trust@hkjobs.demo before testing. We will not pursue a report made responsibly.
Employers, candidates and third-party links
HKjobs is a venue. We verify what we reasonably can — business registrations, licence numbers, the content standards in section 6 — but we do not employ anyone advertised on the Service, do not vet every statement an employer makes, and are not a party to the contract you may eventually sign.
The Service links to third-party sites, including employer career pages and government resources. We do not control them and are not responsible for their content or their handling of your data.
Disclaimers
The Service is provided “as is”. To the fullest extent permitted by law we exclude all warranties, express or implied, including as to merchantability, fitness for a particular purpose and non-infringement.
We do not warrant that you will find employment, receive a reply, or that any listing is accurate, current or lawful. Salary benchmarks are estimates derived from advertised bands; they are not advice about what you should be paid, and nothing on the Service is legal, tax, immigration or financial advice.
Limitation of liability
Nothing in this agreement limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited under Hong Kong law, including the Control of Exemption Clauses Ordinance (Cap. 71).
Subject to that, HKjobs is not liable for loss of profit, loss of business, loss of opportunity, loss of an offer, or any indirect or consequential loss. Our total aggregate liability arising out of this agreement is limited to the greater of the fees you paid us in the twelve months before the claim, or HK$1,000.
Indemnity
If you are an employer, you will indemnify HKjobs against claims, losses and reasonable legal costs arising from a listing you published, from your handling of applicant data, or from your breach of this agreement — but not to the extent the claim arises from our own breach or negligence.
Suspension and termination
You may close your account at any time from account settings. Employers remain liable for fees already incurred.
We may suspend or terminate an account, and unpublish listings, where there is a breach of these terms, a credible report of a fee demanded from a candidate, a business registration we cannot verify, or a legal requirement to do so. Where the suspension is not for a listing that endangers candidates, we will tell you why and give you a chance to fix it.
Sections 8, 11, 12, 13 and 15 survive termination.
Governing law and jurisdiction
This agreement, and any dispute arising out of or in connection with it, is governed by the laws of the Hong Kong Special Administrative Region.
You and HKjobs submit to the exclusive jurisdiction of the courts of the Hong Kong SAR. Nothing prevents either party from seeking urgent injunctive relief in any competent court, or a consumer from bringing a claim in the Small Claims Tribunal where it has jurisdiction.
A person who is not a party to this agreement has no right under the Contracts (Rights of Third Parties) Ordinance (Cap. 623) to enforce any of its terms.
Changes to these terms
We update these terms as the Service changes. The last-updated date at the top always reflects the current version.
For material changes we email account holders at least 14 days before they take effect. Continuing to use the Service after that date is acceptance; if you would rather not accept, close the account and, for a paid plan, we will refund the unused portion of the current term.
